Oral Defendant Corruption Case Trial, Prosecutor Demands 5 Years in Prison

NASIONALXPOS.CO.ID, DENPASAR —Denpasar District Court resumed the trial of the criminal act of corruption accused Oral in a corruption case at a state-owned bank in Denpasar, with an agenda for hearing charges from the Denpasar Public Prosecutor Team (JPU), in the Kartika courtroom, Denpasar. Tuesday, (31/1/2023).

The trial was chaired by Ida Ayu Nyoman Adnya Dewi SH., with case number: 31/Pis.Sus-TPK/2022/PN Dps, on behalf of the defendant Oral, with the agenda for the trial by the Public Prosecutor Team, Denpasar District Attorney’s Office stating that, the defendant Oral was proven legally and convincingly guilty of committing the Corruption Crime jointly and continuously as stipulated in Article 2 section (1) Jo. Article 18 section(1).(2) and section (3) of the Law of the Republic of Indonesia No. 31 of 1999 as amended and supplemented by Law No. 20 of 2001 concerning amendments to Law No. 31 of 1999, concerning Eradication of Criminal Acts of Corruption Jis. Article 55 section (1) 1st Criminal Code, Jis. Article 64 section (1) of the Criminal Code as indicted by the Public Prosecutor Primary.

In addition, the Public Prosecutor also demanded that the defendant Oral be sentenced to 5 (five) years in prison, minus the detention period already served by the defendant with an order that the defendant be kept in custody, and imposed a fine of Rp. 200,000,000.- (two hundred million rupiah) subsidiary 3 (three) months in prison.

In the lawsuit the prosecutor also imposed an additional sentence against the defendant Oral to pay compensation in the amount of Rp. 75,000,000 (seventy-five million rupiah) provided that the replacement money is not paid within a period of 1 (one) month after the court’s decision which has the force of permanent law, then his property can be confiscated by the Prosecutor and sold at auction to pay the replacement money and if the defendant does not have sufficient property then, he will be sentenced to 2 (two) years in prison.

The next trial will be held on Tuesday, 07 February 2023 with an agenda for a plea trial by the defendant and his legal counsel. (Uchan)
